GENERAL TERMS AND CONDITIONS

1. Applicability and scope

The offer is aimed at natural customers domiciled in Switzerland or legal customers domiciled in Switzerland. Deliveries are only made to addresses in Switzerland "(customers"). For deliveries outside of Switzerland, please contact us individually; these GTCs have no effect in this regard.

The following General Terms and Conditions (hereinafter referred to as "GTC") apply to all business relationships between Lena's Premium Closet, Brüderhofweg 6, 8057 Zurich, (hereinafter referred to as "LPC", "us" or "we") and the customer (hereinafter referred to as "customer", "buyer" or "you") for premium second-hand products purchased via our website www.lenaspremiumcloset.com (hereinafter referred to as "online store" or "website").

The Website and the Online Shop are operated by:

Individual agreements concluded with the customer shall take precedence over these GTC. Conflicting terms and conditions of the customer shall not be recognized.

LPC reserves the right to amend these GTC at any time. All amendments shall become effective upon publication of the new GTC on the website. When purchasing a product, the relevant date for the applicability of the valid GTC is the date on which the binding order is placed with us.

Please read these GTC carefully before placing a binding order. By placing a binding order for our products, you agree to the following terms and conditions and declare that you are authorized to enter into legally binding contracts and are at least 18 years of age. 

2. Conclusion of a purchase contract

The presentation of the products in the online store does not constitute a legally binding offer, but merely a non-binding online catalog or a non-binding invitation to customers to order the product in the online store. LPC expressly reserves the right to change the products themselves as well as the content, e.g. images, range, prices and descriptions of our products, at any time and without prior notice. Illustrations, images, brochures, advertising and other information relating to our products are for information purposes only and are not binding on LPC. Product images contained on the website may be incorrect. In particular, colors may differ for technical reasons. Technical data such as dimensions or materials as well as other performance specifications are given as accurately as possible, but may show the usual deviations.

The customer can place a binding order for the products selected by him via our online store. The customer can order the product

which he selects into the shopping cart. This does not yet constitute a binding order. An order is only considered binding when the customer clicks on the "Buy" button after the "Check Out" button on the order page at the end of the order process.

Before submitting the order ("Buy" button), the customer can change and view the information at any time, recognize any input errors and correct them if necessary before the binding final submission of the order. By clicking on the "Check Out" button, the customer accepts our GTCs by ticking the appropriate box. We recommend that you print out or save the GTC on your computer for the purpose of the online order and your documentation

After entering the payment details by clicking the "Buy" button, the customer is immediately and automatically sent an order confirmation by e-mail. This confirmation e-mail contains the details of your order. When the confirmation e-mail is sent, a binding purchase contract is concluded which irrevocably commits you to payment.

Should a product no longer be available in an individual case, we reserve the right to cancel the order within 48 hours of receiving the confirmation email by sending a corresponding email and without assuming any liability towards you.

Any payment already made will be refunded when the order is canceled. Reasons for rejecting an order may be, for example, if a product is no longer available, if we are unable to obtain authorization for the customer's payment or if there is reason to believe that the customer is acting in breach of these GTC, individual contracts, fraudulent or other criminal activities or for any other important reason.

3. Availability and reservation of performance for non-deliverable products

All information about the availability of our products and the dispatch and delivery of our products is provisional information and approximate guidelines. They do not constitute binding or guaranteed shipping or delivery dates. Liability for unavailable products or for delays in shipment or delivery of products is expressly excluded.

Our products are individual items. If LPC discovers during the processing of your order that the products you have ordered are not available, we will inform you immediately. In this case, a contract for the unavailable products will not be concluded, as the ordered product cannot be delivered.

Furthermore, we reserve the right to limit the number of items that can be purchased by a customer. In this case, we will inform the customer accordingly by e-mail.

4.Prices and shipping costs

Our products and prices correspond to those stated on the website. All prices are quoted in CHF (Swiss francs) and include the statutory value added tax (VAT). The total price of your order, including any ancillary and shipping costs and VAT payable, is displayed at the end of the order process. When shipping to countries outside Switzerland (only possible in exceptional cases by individual arrangement), additional customs duties may be incurred. These are not included in the price, are outside the sphere of influence of LPC and are to be paid by the customer.

By placing a binding order, you declare that you agree to the total price for the ordered product.

LPC reserves the right to change prices at any time. The products are invoiced on the basis of the prices offered at the time the binding order is placed.

Shipping is always by registered mail, including any shipping insurance included by the shipping company (currently with Swiss Post max. CHF 1,500).

5. Terms of payment

Orders are generally due for payment immediately.

The customer has the option of paying using the means of payment displayed on the website or during the ordering process. These may change from time to time. In addition, we reserve the right not to offer certain payment methods in specific individual cases and to refer to other payment methods used by us.

By selecting the means of payment, the customer authorizes the payment either by entering the credit card data or access data of a payment service provider. The customer authorizes LPC to collect payments by the appropriate means. In the event of chargebacks, LPC shall be entitled to reimbursement of the associated costs and bank processing fees. Furthermore, LPC is not liable for any fees or other amounts that the card issuer or your bank may charge you as a result of processing your payment in accordance with your order.

If you pay by credit card or alternative payment method, we reserve the right to verify the validity of the card, check the availability parameters for collection and address details and request authorization from the card issuer or payment provider. You also confirm that the credit card is valid and that the payment details entered are correct. If the payment is rejected, LPC reserves the right to cancel the order and stop shipping the product. In this case, we will contact you immediately. The product will then be released for sale again immediately.

6.Delivery conditions

The products will be delivered to the delivery address specified in the order. Delivery is always made via the Swiss Post AG delivery service.

For shipping outside Switzerland, please contact us individually using the contact form. We will then endeavor to find the best shipping solution for you.

Shipping is always by registered mail, including any shipping insurance included by the shipping company (currently max. CHF 1,500 with Swiss Post AG).

Products that you order in our online store will usually be delivered to you within Switzerland within 1-5 working days after receipt of full payment. LPC is not responsible for delivery delays on the part of the shipping company, regardless of the cause.

If the customer does not accept ordered and delivered products or if the customer does not collect them from the post office or a designated post office box within the period specified by the post office or delivery service, you will be in default of acceptance on the day after the attempted delivery or after the expiry of the collection period. The non-acceptance of the products ordered by you does not release you from your obligation to accept this delivery and to pay all amounts owed in accordance with the purchase contract on time. The shipping costs and all other costs incurred by LPC as a result of your default of acceptance shall be borne by you.

Should the delivery of the products fail through the fault of the customer despite three delivery attempts, LPC may withdraw from the contract. In this case, any payments already made by the customer will be refunded in the form of an LPC voucher.

7. Transfer of ownership

The ownership of LPC shall only be transferred to the buyer once the purchase price has been paid in full.

8. Right of return

As a gesture of goodwill, we grant you a 3-day right of return for orders placed via our online store. You must exercise this right within 3 bank working days in Switzerland from receipt of the goods. Please contact us in advance about an intended return by e-mail at info@lenaspremiumcloset.com

If you exercise your right of return, we will issue you with an LPC value voucher in the amount of the purchase price. A refund of the purchase price in cash is not possible. The LPC voucher will be issued once we have received the goods back. You must pay for shipping and all return transportation costs yourself.

The issue of an LPC voucher for the full amount requires that the product is still in the same condition as when it was handed over to you. If the condition of the product deteriorates, LPC reserves the right to reduce the amount of the LPC value voucher in accordance with the deterioration of the product or to refuse it completely.

 

9. Notice of defects/warranty 

LPC guarantees that the products are 100% authentic original products. Each product is carefully checked. If a product is not authentic, we will refund 100% of the purchase price immediately.

Furthermore, LPC guarantees that the products correspond to the warranted characteristics and have no defects that impair their value or suitability for the intended use. As the products are generally used individual items, normal signs of use to the extent specified in the description of the respective product do not constitute a defect. The states of use are defined as follows:

New: The product is unworn. No visible signs of wear.

Very good: The product has rarely been worn. Slightly visible signs of wear.

Good: The product has been worn. Visible signs of wear.

Loved: The product has been worn often. Clearly visible signs of wear.

Upon receipt of the product, the customer must check it immediately for correctness, completeness, any deviation from the described condition of use or any other defects. Errors, deviations from the described state of use or other defects must be reported to LPC within 3 working days.

10. Praise, complaints and claims

We attach great importance to customer satisfaction. You can reach us at any time using the contact information provided at the beginning of this document. We will endeavor to process your requests, praise and complaints as quickly as possible and will contact you upon receipt of the documents or your submission or complaint. If you have any claims or complaints, please help us by telling us the exact problem and, if necessary, providing a copy of the order documentation or at least the order number, customer number, etc. We will endeavor to respond to you within 3 working days.

The data required for business transactions will of course be treated confidentially.
